LITTER PICKS' ROLE
Litter Picks is not an auctioneer, nor an intermediary between the Buyer and the Seller (“Breeder”). Litter Picks provides a web-based platform for Breeders to list their pets for sale and buyers to pay an initial deposit for those pets. The deposit is not a guaranteed contract for sale and Breeders have the right to accept or reject that deposit based on information provided about the Buyer. Acceptance or rejection of the deposit is left to the sole discretion of the Breeder. Litter Picks is not involved in the actual transaction between Breeders and Buyers and is not the agent of the sale and has no authority for either, for any purpose.
By submitting a Pick Deposit, the Buyer agrees to all Terms and Conditions of this document as well as any specific Terms and Conditions set forth in the Breeder’s web page. Buyer agrees that this deposit is not a contract for purchase of the pet and Breeder has the right to accept or reject the Pick Deposit. If the Pick Deposit is accepted by the Seller, this will put Purchaser in line for the pick of the litter that was specified on the deposit purchase. This deposit is non-refundable unless Seller determines that the puppies are not a good fit for the Purchaser or the Purchaser is unable to provide for the puppy and Breeder deems a refund is warranted. Breeder is not required to refund the deposit. Purchaser agrees that they will communicate with the Breeder and provide any information needed prior to pick up. Purchaser also agrees that they will pay the required Pick Up amount due when the puppy is picked up and will agree to and sign and paperwork and/or contracts required by the Breeder.
By listing the Litter Picks for sale, Breeder agrees that they have the authority to sell the pets and that they pets are in their care until the actual sale contract is made. Breeder agrees that they will notify the Buyer within 48 hours of the Pick Deposit payment as to whether the deposit is accepted or rejected. Breeder has the right to reject and Pick Deposit for any reason. If, after the Pick Deposit is accepted and paid, the Breeder feels the pets are not a good fit for the Buyer, Breeder may notify the Purchaser and either refund their Pick Deposit or apply their deposit to a future litter. Breeder agrees that they will provide good care for the pets and will have all stated health screenings, tests, or procedures done on the pets prior to Pick Up day. Breeder also agrees that they will communicate with Buyers with regard to amount due at pick up, date and time of pick up, and any other required paperwork or contracts needed to complete the sale of the pet.
Any disputes or disagreements between the Breeder and Buyer will be resolved solely between the two parties. Litter Picks provides a means for marketing picks of a litter but is in no way involved in the deposit or purchase contract between the Breeder and the Buyer. All legally binding pet purchase agreement will be made between Breeder and Buyer outside of the realm of the Litter Pick site.
